Payment terms

Engagements are quoted as a fixed fee per tier (24h, 48h or 72h). 50% is due on brief acceptance to reserve the slot; the remaining 50% is due on delivery of the public URL.

Invoices are payable within 7 days of issue, in USD or EUR, by bank transfer or card. Late balances accrue 1.5% interest per month from day 8.

The reservation deposit is non-refundable once the slot is held, except where we miss the delivery window for reasons within our control — in which case the week is on us, per our House Rules.

Delays & timelines

Our tier clocks (24h, 48h, 72h) assume same-day decisions from the client. We pause the clock when we are blocked on a question, asset, copy approval, DNS access, third-party login, or any other input owed by the client.

Brainy is not liable for delays caused by client unresponsiveness, late-arriving content, scope changes mid-build, third-party outages (hosting, DNS, payment processors, analytics, font providers, CMS vendors), force majeure events, or regulatory review timelines.

If a project is paused at the client's request, the slot is released and a new slot will be scheduled subject to availability. Resuming may require a new deposit.

Platform neutrality

Brainy is platform-agnostic. We pick the stack that fits the brief — static, framework-rendered, CMS-backed or otherwise — based on the project's goals, not vendor relationships.

Nothing on this site constitutes an endorsement of, or affiliation with, any specific development framework, hosting provider, CMS, no-code tool, AI tool, or build platform. Trademarks belong to their respective owners.

Where third-party services are used to deliver a project (hosting, analytics, fonts, CMS, payment processors), the client is bound by those vendors' own terms and pricing. We will surface those choices in the handover document.

Ownership & IP

On final payment, the client owns the final source code, design files and copy delivered for their project, with a perpetual worldwide license to use, modify and redeploy.

Brainy retains the right to display non-confidential work in our portfolio, case studies and award submissions, unless an NDA is signed before kickoff.

Generic components, libraries, methods and internal tooling used to deliver the project remain Brainy's property and may be reused on other engagements.

Warranty & support

We warrant delivered work to be free of material defects for 14 days from launch. Bugs reported in that window are fixed at no charge.

Beyond 14 days, fixes, edits and new features are billed at our then-current rate or via a retainer.

We do not provide 24/7 uptime monitoring or guaranteed SLAs unless contracted separately.

Privacy

Information submitted through our contact form (name, email, company, brief) is used only to respond to your inquiry and deliver the engagement. We do not sell, rent or share it with third parties for marketing.

This site uses privacy-respecting analytics to measure traffic in aggregate. No cross-site tracking, no advertising cookies.

Requests to access, correct or delete your data can be sent to hello@brainymarketing and will be honored within 30 days.

Terms of use

This website is provided as-is for informational purposes. Content may change without notice. We make no warranty that the site will be uninterrupted, error-free or fit for any particular purpose.

To the maximum extent permitted by law, Brainy's total liability for any claim arising out of an engagement is capped at the fees paid for that engagement.

Disputes are governed by the laws of the jurisdiction in which Brainy is registered, without regard to conflict-of-laws principles.
